Terms of use

The ground rules for using FreierTermin.

This English version is provided for convenience. The German version is the reference text.

1. Scope and provider

These terms of use apply to the use of FreierTermin (freiertermin.com) including the web app. The provider is Ferhat Mert Kaya (Kaya Bytes), address in the legal notice.

2. What FreierTermin does – and does not do

  • FreierTermin is a free, independent information service and not a government authority. We help you find the responsible offices, compare appointment offers and get notified.
  • You always book appointments yourself, directly on the official website of the responsible office. FreierTermin does not reserve, book or cancel appointments for you.
  • Availability information is determined automatically and may be outdated or incomplete. Only the authority’s official booking system is authoritative.
  • We cannot guarantee that an appointment shown is still available when you open the official website. Notifications are a hint, not a reservation.
  • Not every authority can be checked live. Where this is not possible or not permitted, we only link to the official website.

3. Account

  • You need an account for alerts, saved appointments and notifications. Search works without one.
  • You must be at least [insert minimum age, e.g. 16] years old. [REVIEW]
  • Please provide truthful information and keep your credentials secret. Let us know if you suspect misuse of your account.

4. Fair use

You use FreierTermin for your own private purposes only. In particular, you may not:

  • read FreierTermin automatically or systematically copy content,
  • search for, collect or resell appointments for third parties commercially,
  • circumvent security measures or overload the service,
  • enter details about nationality, residence status, health or other sensitive data in free-text fields.

5. Availability and changes to the service

FreierTermin is under development. We strive for reliable operation but do not owe any particular availability. We may change, restrict or discontinue features, in particular if an authority does not want automated checks or legal reasons stand in the way.

6. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slightly negligent breaches of essential obligations, liability is limited to the foreseeable, typical damage; otherwise liability for slight negligence is excluded. For missed or not received appointments we are liable only in accordance with these principles.

REVIEWReview the liability clause for a free service (§§ 521, 599 BGB by analogy?) and its relation to §§ 7–10 DDG.

7. Term and termination

You can delete your account in your profile at any time without giving reasons. We may terminate the user agreement with two weeks’ notice, and without notice for good cause (e.g. misuse).

8. Right of withdrawal

[insert withdrawal notice, if required] [REVIEW]

REVIEWSince 2022, consumer contracts for digital services where consumers provide personal data may fall within the scope of §§ 312 ff. BGB (§ 312(1a) BGB). Clarify whether a withdrawal notice is required for the free account.

9. Changes to these terms

We inform you of changes by e-mail at least four weeks in advance. If you do not agree, you can delete your account at any time. [REVIEW: consent mechanism]

10. Applicable law

German law applies. If you are a consumer habitually resident in another EU member state, you retain the protection of the mandatory provisions of that state.
